Madurai : State to file SLP before SC on allotting MBBS seat to blind boy
The state government has informed the Madurai bench of the Madras high court that it would be filing a special leave petition (SLP) before the Supreme Court in a contempt plea which sought action against the officials for not allotting a MBBS seat to a visually impaired boy.
Taking into account the state’s submission, a division bench of justice K Ravichandrabaabu and justice Senthilkumar Ramamoorthy which heard the case on Thursday adjourned it to June 27 for further hearing.
In his contempt petition, J Vibin, a minor boy represented by his father Jabakar, a resident of Tirunelveli district stated that he had filed a petition before the high court seeking to admit his son in the Pudukkottai Medical College to pursue MBBS course.
He stated that when the petition came up for hearing, the court directed the authorities concerned to accept the certificate issued by the Madras Medical College categorizing the petitioner’s son as suffering from 90% degree disability (visual impairment) and implement the allotment already made in the Pudukkottai Medical College or allot any other college within the state. He further submitted that the state government also appealed against the order of the single judge, however, it was dismissed by the division bench.
As his son is being deprived of right to education, the petitioner filed a contempt petition and prayed for a direction seeking to take action against the concerned authorities for failing to comply with the order of the court.
