• Smart Labs barred from using Aziwake; mark alleged to be deceptively similar to Dr Reddy’s trademark Aziwok

  In an interim order issued on Thursday, the Delhi High Court has restrained Smart Laboratories from utilizing the mark "Aziwake." The court ruled that this mark is allegedly deceptively similar to Dr Reddy's Laboratories' registered trademark "Aziwok," whether used with or without any prefixes or suffixes. The restriction applies specifically to pharmaceutical preparations and any other allied or cognate goods or services.

  

• Karnataka HC takes serious note of shortage of doctors & medical staff, initiates PIL on its own

  The HC, pointing to the report, noted that there is a shortage of primary health centres in 454 rural areas. The report also said there is a shortage of 723 MBBS doctors, 7,492 nurses, 1,517 lab technicians, 1,517 pharmacists, 1,752 attendants, and 3,253 Group D workers, constituting various categories of medical staff.

  

• Live-in relations are infatuation, lack sincerity: Allahabad high court

  The Allahabad High Court in India has dismissed a plea by an interfaith live-in couple seeking police protection, stating that such relationships are often driven by infatuation and result in temporary and fragile arrangements. While acknowledging that the Supreme Court has validated live-in relationships in the past, the division bench of Justices Rahul Chaturvedi and Mohammad Azhar Husain Idrisi emphasized that unless the couple decides to marry and commit to a serious relationship, the court will not express an opinion on such arrangements. The case involved a petition filed by a Hindu-Muslim couple challenging an FIR lodged against the man by the woman's aunt.

  

• No case of negligence if complications unrelated to medical procedure: SC

  The court noted that no case of negligence is made out if complications suffered by the patients are not related to the medical process.

  

• Supreme court verdict today on right to marry for LGBTQIA+ people

  The Supreme Court of India is set to deliver its verdict on a batch of petitions by the LGBTQIA+ community seeking the right to marriage under the Special Marriage Act. The community argues that discrimination based on sexual orientation and gender identity violates constitutional guarantees of equality, non-discrimination, freedom of expression, privacy, and dignity.

  

• Unfortunate permanent State Mental Health Authority not constituted, says Delhi HC; seeks Health Secretary's presence

  The Delhi High Court has shown disappointment over the non-constitution of the permanent State Mental Health Authority under the Mental Health Act, 2017, and directing the Delhi Health Secretary to appear before it on the next date of hearing on September 15. The court was dealing with a Public Interest Litigation (PIL) filed by advocate Amit Sahni, who sought effective implementation of the Mental Healthcare Act.

  

• Stipend statutory right of PG medicos, says HC

  According to the colleges, a group of PG students at the institutes had grievances in payment of stipend for 2017-18 to 2019-20. Allowing their pleas, a single judge of the court directed the colleges to pay the stipend within four weeks. Aggrieved, the institutions have moved the present appeal. According to the colleges, the students had a dispute in payment of fees as specified in the brochure.

  

• HC: Set up Mental Health Authority

  During hearing of a petition filed by MP State Legal Aid Authority and High Court Legal Service Committee on Thursday, the court was told that the State Mental Health Authority has been constituted by the state government sans Mental Health Review Boards and other necessary provisions to make the body functional.

  

• Hosp delays US-bound man’s COVID report, told to refund fee

  Uttarahalli resident Gautham was scheduled to fly to the United States at 1.30am on December 27, 2021 from Bengaluru’s Kempegowda International Airport (KIA). With the pandemic situation persisting, the US had then mandated that people flying in from India must carry a Covid negative RT-PCR test report taken within 24 hours from the time of departure.
